Unfair trash fine, 1000 Bxl

Question

Hi there, I have received a fine from the Brussels commune that I'm living in, saying that I violated the cleanliness:
- put the trash in a wrong place (the street corner behind our building, more or less below our balcony on the first floor, whereas we take it all out in front of the building)
- put it on the wrong day (it was written Friday morning, but our usual pickup times are Monday and Thursday mornings)

I am very conscious about the trash, sorting it properly, I must be the only person in the building recycling organic trash in the orange bag..

Is there a way to appeal and ask for proof?
Can I refer this to the landlord (living in the same building) if he'd have a leverage? There is also a restaurant whose owners have surely seen me taking it out in the nights in my PJ.

Thanks in advance for your help!

J

Nothing to do with landlord. Although, you might mention this to him and see if he's had one as well.

It's not impossible that they are just trying it on. I did know of someone who had the same problem. He appealed, they took him to court, and about 18 months later, the court cancelled the fine, as there was no proof.

Thank you, I'll see what happens with the appeal.
