Type B Card Eligibility & How to Apply in 2020?

Question

Hi,

I am a non-EU citizen. I have recently completed my 5 years in Belgium officially. Currently I am under single permit regime which valid for 2 more years. My single permit is tied to my organization. So, to change the job I need to apply the work permit again.

Could you advice me how to apply for Type B card or equivalent in 2020? As the commune or Vreemdelingenzaken department are redirecting me to check with Brussels foreign affairs.

Earlier as per my research and information from colleagues, it was possible to request for the Type B card at the commune. But, now they are not allowed to do it.

Please advice what should I do?

Earlier the laws used to be that after the application of the 6th work permit you would automatically get the B-card (PR card) but now that the WP and RP cards are linked, not sure how it works.

Best to ask other communes as well, just to get a double confirmation.

Actually on second thought, once the 6th WP is applied for then you're corresponding residence permit should be a permanent resident card. In case they dont give you a B-card, you can manually apply for a D-card as you fulfill the conditions.

My current WP is valid till 2022. So let say I apply for a new job, could they approve me a Type B card?

Could you apply type D card from Type A card Directly?
5 years is enough for applying Type D card?

A. Yes possibly but you'll need the city hall to ask for a new residence permit based on the new WP and then you'll get your answer.

B. Yes as long as you have a job and have completed 5 years you become eligible for a residence permit D.

However since start of 2019 many rules changed and the expectation maybe differ so best to ask the city hall. If you're not getting a clear answer from person A then come back another day and ask someone else, hopefully someone else might have the most updated information.

Hi CRISSCROSS,

Thanks for the replies :)

My situation is for the first 2.5 years i worked as an onsite employee (with expat status) in Belgium from India and then the rest i worked 2.5 years more for a belgian company on local contract and still working.

Am I eligible for PR or citizenship as I have officially worked here for 5 years (uninterrupted)?

Does it really matter. I thought 5 years from the First RP was enough for the PR or nationality.
