Resigning / changing jobs within Belgium.

Question

Hi all, hope you can help me with a couple of queries?

I have been offered a new job and the new employers would like me to start in January 2014.

In terms of resignation, i believe that would need to work 6 weeks notice...full time open ended contract with less than 5 years service. Is this correct? So in theory I can resign in November and this will commence 1st December...leaving me free to change mid January.

Also, in terms of eindjaarpremie (usually paid at the end of December), does my current employer still have to pay me this?

I have also heard that the old employer will have to pay 0.92 month for vacanciegeld in 2014 and not the new employer. Is this correct?

Any helpful info will be greatly appreciated.

6 weeks notice sounds correct.

Your current employer will pay your end of year thing as usual in December.
They will also pay you ALL due holiday pay when you leave. Save it, because you may not get paid holiday in your 1st year with your new employer.

Your new employment will fall under this new "statut unique" - no trial periods, very different notice periods. worth reading up on.

Your holiday payment and other benefits all get paid a year later. This employment lawyer might be able to help you. Mr Paul De Brouwer. Tel. 054 41 75 61. He speaks English. Can I have your old job? I think a 15 minute telephone conversation for advice is free.

I am also changing jobs. My boss is ok with me so notice period is not causing any problems. My question is can I write the resignation letter in English? and are there any particular things to specify in this letter?

Thanks.

Thanks for the answers. Appreciated.

It will suck a bit if I don't get any paid holiday (you mean the 25days?) but that's life.

Brusselli, I think it needs to be in either french or dutch if you are in Brussels. I'm writing mine in dutch just to be sure. I think you also have to send it via registered mail but you can give a copy directly to your employer.

Hello again, is there any special template for this letter that we can consult on the internet?
