problem with landlord
My ex-landlord demands that I pay him for damages to the appartment (etat des lieux de sortie). Before making a payment, I have asked him to provide details of provision that I paid. When living in the appartment, I paid 50 EUR each month: 20 provision for water and 30 EUR for some general cleaning, etc. Before moving out, the landlord told me that I will get water bills recalculation and explanations on what these 50 EUR was spent. Now he does not give me any details about it. But demands that I pay him for damages to the appartment. I asked already twice to provide details on what he was spending these 50 EUR per month, but no reply. Can I legally demand that he gives me explanation how he spent it? Water bills, cleaning bills or how he spent these money? He is very quick to demand that I pay him, but he has no wish to be accountable how he spent my money. Thanks.
Normal. Send a registered letter in the language of your contact asking for a detailed list of damages and amounts plus water and cleaning serves - titres service. if he doesn't provide then do not pay. He can't come after you if he didn't register your lease. Was the exit done by a professional , are there pictures etc?
Our landlady tried something similar but we didn't have an expert. We had all of our pictures repaired things ourselves and then yelled our heads off when she demanded more. she gave in and then we separated. come to find out she didn't pay a bill and 3 years later they came after us. We sent them back to her but it was a huge hassle....so beware!
The damage assessed through the etat de lieu and the money you have paid each month for water and the cleaning of communal space and any other monthly charges you may have been assessed don’t really have anything to do with each other. You have acknowledged that there was some damage and have signed the etat de lieu which was done by an expert. You will have to pay that. You may also have some charges for water etc. but he may not be able to tell you what these charges are for some time, until he gets the bills. This is especially true if you are in a large building where the heating is divided up among more apartments. However he does have to tell you what the monthly charges you have been paying are for, and he does have to justify what he is charging you for with appropriate bills from the water and other companies. You have a right to ask for these bills as well as what portion of the bill you are responsible for.
