Power of attorney - UK or Belgian?

Question

Hi All
Looking at starting a power of attorney for myself but composed in which country? My PoA would be my UK neice living in Belgium. My will is in England.
Any thoughts.

bobk100 you want to appoint your niece as as a Power of Attorney. Go and see a notaire.

Also, please be careful taking advice from anyone on the internet (including me) as some of the advice above (such as for cash "the estate pays maximum tax") is totally wrong and betrays a complete misunderstanding of Belgian (and UK) inheritance taxes and laws.

my sister and I have this for an elderly relative with declining cognitive function. My sister resides in the UK whilst I'm in Belgium. It was drawn up in the UK and no issue that I lived outside the UK. I hope that helps

Although as the relative is also in the UK its probably not what you asked having read your later post As above seek clarification from a notair here. Be aware life insurances payments maybe taxed in Belgium. If you are in Belgium and so is your niece maybe simpler also have a will here to cover all eventualities just my opinion

To anon. Maybe my wording was incorrect because the tax varies depending on the amount being left. But you can reduce the level by making gifts in advance.
However, I have made it very clear that he should consult a good notary and one who understands the issues of dealing with two countries. In a reply he also stated that it was cash here.
