Laid off and new job situation

Question

Hi,

I was terminated from my Job on Jan 20 and my notice period ended on March 2nd.

I have applied for unemployment benefits and the ONEM has asked for Annex 51 document (that tells me to leave the country after three months of job end date). I asked the commune for the document and they said they didn't receive any such document from Ministry.

In the meantime I got a job offer in April who initiated my new Single Permit during the first week of May. I am still waiting for the approval and haven't received the Annex 49 or Annex 46.

Now the question is, on June 2nd, I will finish 3 months without a job.

Would I be asked to leave the country or I can stay as my new SP is filed and I am waiting for decision?

I still have a valid Resident Permit that is valid till April'2023 and I am also eligible for 5 year PR card which I have applied in January and should get it end of June.

Could any of you guide me with this and what I need to do in case I don't receive the new SP approval before June 2nd? And also should I be talking to my commune asking for the status of Annex 51 or leave it for now?

J

First let's have a game of "guess the nationality"!

I am a non-european and an Indian Citizen. Not sure if that makes any difference to my question(s) or concerns. May I now request for a feedback on them please!

Hi
here is my experience.

when I resigned my job, My card was valid for 9 more months and I lived with that card and found another job. But I have never approached onem for unemployment benefits. During this time, I used to renew the belgian ID yearly.

Currently, the belgian ID validity is max 3 years or the length of the job contract. I am not sure how this can change the clauses.

Yes VIJAYBHASKARPS, I can now confirm that as someone with an EU nationality, I have absolutely no feedback whatsoever on your situation as the law as it applies to me is not the same as the law as it applies to you.

Hi,
Normally as soon as your work permit is submitted and processing in progress, you are authorised to stay in Belgium.

But you might not be able to travel outside Belgium.
