My child born last week and am a Belgian national by acquisition. My child would get nationality as per me or by his mother(non-Eu)?

If one of the parent is a belgian, then the new born child gets automatically belgian citizenship but the child can decide at the age of 18 which citizenship he/she wants to keep (one from mother or the one from father).

the rule:

Art. 8. § 1. Belg are:
1st child born in Belgium to a Belgian parent; 2nd child born abroad:
a) from a Belgian parent born in Belgium or in areas under Belgian sovereignty or under Belgian administration;
b) from a Belgian parent who has made a declaration within five years after the birth, in which he requests to be granted Belgian citizenship to his child;
c) from a Belgian parent, provided that the child no other nationality or reserves until the age of eighteen years or emancipation for that age.

When you go to register the birth (which you are required to do by law) you should ask the commune. They will be the best placed to know.

FYI, registering the birth itself has nothing to do with a claim, or otherwise, for nationality.

Given your circumstances, I would have thought that the child will be able to claim Belgian citizenship. However, as J notes above, your child may also have an equally valid claim for citizenship of your wife. You may want to consider getting both.

Also - you may want to consider getting the birth registered at the embassy of the child's mother. It makes it far easier in the future if you ever need birth certificates etc. in your original language.

No choosing to drop Belgian nationality exists aged 18.

Commune officials have no authority to comment on nationality other than Belgian

Sorry what I mean is you are not obliged aged 18 to choose nationality if you are a Belgian national. You can keep Belgian nationality and other nationalities if laws of other nationalities allow.

You can have 4 or even more nationalities you can have several from each parent more from country of birth and more from residence.

Being born here does automatically grant citizenship I have a brutish child born here because we are both British seek advice from your old embassy and your wife's to ensur all necessary forms are completed but I do think if you're Belgian then your child can be too
