Belgian Tax on UK property?

Question

Can anyone tell me if you own a house in the UK (the tax declaration is done there and income is very small after paying mortgage so it's not subject to much tax). Do you also have to declare this on the Belgian Tax declaration if its already taxed and declared in the UK? Will the Belgian authorities tax all the income or will they deduct the mortgage? What is the level of tax to be paid exactly?

If it's taxed in the UK, you need to declare that income in Belgium, but you should not be taxed on it, as there is a double-taxation traty in place between BE and UK.

If in doubt, go to the commune tax clinic and ask them how to correctly declare the income on your tax return.

The tax treaty would merely cover the tax you already paid in the UK, it does not mean you don't owe more to Belgium. Last time I looked, the EU was giving Belgium flak for applying punitive taxes on foreign rental income that it was not applying to Belgian rental income. As said, best place is the commune tax clinic.

Our Belgian tax officer told us that if you declared you had property in the UK they would tax you on what they deemed the rent that you could receive for the property - this may be more or less than you actually get! Belgians are also taxed on the rental income property that they own abroad.

When we rented our UK house out, the income was taxed in the UK, and not Belgium. It was declared on Belgian tax returns.

Failure to declare this is an offense, and will lead to a fine.

If it's your sole home rented out unfurnished, then it will be exonerated in the same way as it is as if the property is in Belgium.

I ask the same question every year and get this as the same answer, so every year the income has been declared and exonerated.

It is a very bad idea to not declare income.

We did this and lived in rented here and my husbands work had a firm help him with the forms. We actually had more hassle from the UK in terms of me as a trailing spouse with no income having to fill in a ta. Return on a property that basically made zero renvue because of mortgage and maintain a e cost.
